If the other party in your accident has their motor insurance with an insurer represented by Van Ameyde, we are your point of contact. You do not need to handle the often foreign-language correspondence with the insurance company. We will manage all the necessary communication with the foreign insurer to process your claim.
To achieve our goal of having the necessary information for processing quickly and efficiently, we kindly ask that you conduct all communication (including the submission of documents and inquiries) solely with us. This way, we are always up to date, and nothing slips through the cracks that could later cause problems.
Please prefer to send documents and inquiries via email. An additional submission by post or fax is not necessary. Even if you choose another method of submission (e.g., by post), a single submission is sufficient.
We need evidence of the involvement and liability of the foreign vehicle/parties. This includes, in particular, the Green Insurance Card or other insurance documents, as well as:
- A European Accident Report completed and signed by the parties involved in the accident,
- Photos of the accident scene clearly showing the involved vehicles and their license plates,
- Complete information about witnesses or their statements,
- A police report, or
- Other suitable evidence.
Additionally, we kindly ask you to specify and substantiate the nature and extent of the claims for damages being made.
No, there are no costs incurred by you for our services. Our contractual partners are the foreign insurers, whose interests we represent, and we bill our fees to them after the case is concluded.
Accident Abroad
Who is at fault for the accident and what specific claims you have depends on the legal regulations that apply in the country of the accident. This means that in the vast majority of cases, you do not have the same entitlements as in the event of an accident in your own country.
First, we clarify the insurance coverage. To do this, we always need explicit confirmation of insurance cover from the foreign insurer. In addition to insurance coverage, the notification of damage by the foreign party and the insurer’s statement on liability under the applicable national law are also required.
After the foreign insurer has conclusively assessed the liability issue, we can give you a final statement on liability. However, the settlement of the claim is only possible if the insurer has also released the amount of the claims for damages and provided us with a corresponding advance payment.
Due to the legal peculiarities, the different liability issues and the more extensive correspondence, the settlement of a traffic accident abroad often takes much longer than that of a traffic accident in one’s own country.
However, we have no influence on this. However, in the interest of all parties involved, we strive to avoid any delay in the settlement and to conclude the matter quickly so that all payments can be made, including our fees.
As claims representatives, we must either have settled the claim or issued a reasoned opinion within three months. This period begins as soon as you have provided us with all the necessary information and documents.
We treat claimants with and without legal representation equally as a matter of principle. Of course, you are always free to involve a lawyer. However, please keep in mind that lawyers’ fees are not reimbursed under every state law.
Accident In One’s Own Country
Who is at fault for the accident and what specific claims you have is determined in the event of an accident
- in Switzerland in principle according to Swiss law
- in Germany in principle according to German law
- in Austria in principle according to Austrian law
First, we clarify the insurance coverage by obtaining explicit confirmation of insurance coverage from the foreign insurer. In addition to insurance coverage, the notification of damage by the foreign party and the statement of the foreign party on the course of the accident are also required.
Sometimes further investigations, such as obtaining witness statements and/or a police report, are necessary. On the basis of the information then available, we finally carry out a liability assessment and check the submitted damage documents. Depending on the result we come to, we finally enter into regulation or reject the obligation to enter.
The settlement of a traffic accident with foreign participation often takes much longer than that of a pure domestic claim, in which all parties involved are insured by domestic insurance companies. We have no influence on this. However, in the interest of all parties involved, we are trying to avoid delays in the settlement and to conclude the matter quickly vis-à-vis the insurers. Only then can all payments be made, including our fee.
If the insurance cover is not confirmed, we will notify the DBGK (Germany) | NBI-NGF (Switzerland) | the VVO (Austria), combined with a request for a re-investigation. In addition, it is possible to register the claim via the DBGK | NBI-NGF | VVO at the expense of the foreign country office by way of so-called license plate regulation. However, for this to happen, the involvement of the specified foreign license plate and the liability must be proven beyond doubt by you.
